Council on Foundations Plans to Step Up Advocacy - Government ...

In an e-mail last night to her group?s membership, Vikki Spruill, the new leader of the Council on Foundations, announced a campaign to convey the value of philanthropy to lawmakers.

She painted a picture of philanthropy under threat from politicians who are looking for new ways to increase revenue.

?Both President Obama and Governor Romney have put forth plans that will affect giving, and Congress is eyeing all tax deductions as potential revenue raisers,? she wrote. ?This would be a grave mistake and would negatively affect significant numbers of Americans.?

Since joining the Council in July, Ms. Spruill said, she has assembled a team of ?seasoned political strategists, communications tacticians, and tax-policy experts with deep ties to federal policy makers.? The campaign will focus on educating lawmakers at the local, state, and federal levels, she said, showing them how philanthropy has changed lives, created jobs, and transformed communities.

Other nonprofit leaders have been sharpening their sabers in anticipation of renewed efforts by governments to limit the charitable deduction and introduce other changes they say would harm giving. President Obama has proposed capping all deductions for wealthy people at 28 percent, while Mitt Romney has said he would limit total deductions to $17,000 for middle-class families.

Last month, Independent Sector, an association of charities and grant makers, released a report calling for the creation of a single organization to lead such advocacy efforts.

Fla. man charged in NY dinosaur fossils case

MIAMI (AP) ? A Florida man was charged Wednesday with smuggling dinosaur fossils into the United States, including a nearly complete Tyrannosaurus Bataar skeleton from Mongolia, federal prosecutors said.

Eric Prokopi, a self-described "commercial paleontologist" who buys and sells whole and partial dinosaur skeletons, was arrested at his home in Gainesville, according to a complaint unsealed by prosecutors. He was charged with smuggling goods into the U.S. and interstate sale and receipt of stolen goods.

He also faces one count of conspiracy to smuggle illegal goods, possess stolen property and make false statements. If convicted on all of the charges, he could face up to 35 years in prison.

Prokopi made an appearance Wednesday in federal court in Gainesville, where U.S. District Judge Gary R. Jones ordered him to be held on $100,000 bond. Prokopi must also surrender his passport and be kept under home detention. He did not enter a plea.

The arrest was handled by U.S. Immigration and Customs Enforcement's Homeland Security Investigations.

Manhattan U.S. Attorney Preet Bharara said the investigation "uncovered a one-man black market in prehistoric fossils." The U.S. government seized the Tyrannosaurus skeleton earlier this year after it was sold by an auction house for $1.05 million.

Prokopi did not immediately respond to a phone call, but his attorney has said he did nothing wrong.

Prokopi has been involved in a lawsuit in New York over the auction because the Mongolian government has said it may belong to that country. Prokopi's attorney in the lawsuit, Michael McCullough, has said his client is entitled to keep the creature he spent a year putting together at great expense.

McCullough has said the U.S. government was incorrect when it alleged that the skeleton pieces were brought into the country in one $15,000 shipment. He said there were three other shipments and only 37 percent of the completed skeleton came from one specimen.

Federal prosecutors said Prokopi misrepresented the identity, origin and value of the skeleton of the Tyrannosaurus bataar, a dinosaur that lived approximately 70 million years ago.

Prokopi also is accused of illegally importing from Mongolia the skeleton of a Saurolophus, another dinosaur from the late Cretaceous period that he sold to a gallery in California along with fossils of two other dinosaurs native to Mongolia, Gallimimus and Oviraptor mongoliensis. He also imported the fossilized remains of a Microraptor, a small, flying dinosaur from China, the complaint said.

Prokopi brought the fossils into the country between 2010 and 2012, prosecutors said.

Why Pets Should Be Included in the Presidential Debate ...

Yes, I want to hear about?Mitt Romney?s tax plan.? And, yes, I?m very interested in Obamacare.? And foreign policy.? And the deficit.? And the mortgage crisis.? But there?s another topic I?m just as interested in, one I?d like both?presidential candidates?to be asked about at the next debate: how to solve our national?companion animal?crisis.? Namely, how to remake a system that wastes hundreds of millions of taxpayer dollars on housing, and ultimately killing, millions of healthy dogs, cats and other companion animals.

Perhaps some of you just rolled your eyes, but I?m guessing not many.? After all, according to theAmerican Pet Products Association?s?National Pet Owner?s Survey in 2011, 62% of all American households include at least one pet. There are over 78 million owned dogs and 86 million owned cats (?owned?, meaning not a stray, currently for sale, or awaiting adoption in an?animal shelter?or rescue organization).? In 2011, Americans spent $51 BILLION on our companion animals, the highest expenditure ever, even in the face of global recession.? In short, we Americans love our pets.? And many of us spoil them rotten.

But just like with the ubiquitous ?99%?, inside the pet population, there are clearly the ?haves? and ?have-nots.? The ASPCA estimates that 5 to 7 million companion animals enter animal shelters each year. 3 to 4 million of those, the majority of whom are healthy and adoptable, are killed for lack of space, or because they slowly became unadoptable after living in the high-stress environment of a shelter for a period of time.? This is unacceptable to anyone who cares, who acknowledges the positive effects of sharing our homes and our hearts with those who have paws (or wings).? If you?ve ever cried into the fur of your beloved dog or cat, you know that this method of dealing with homeless animals must stop.? As Mahatma Gandhi famously said, ?The greatness of a nation and its moral progress can be judged by the way in which its animals are treated.?? What does it say about our national morality that we find it acceptable, if sad, to take the lives of innocent creatures, creatures full of potential to love and be loved, to be a best friend and family member, but who instead leave the shelter in a trash can?

And then there are the tangible fiscal issues. ?The?candidates?are debating cutting miniscule funding for Big Bird while governments in every city and county in the nation pour taxpayer dollars into the rounding up, housing, and killing of innocent animals. ?That money could be used to help underserved kids, Mr. Obama, or refunded to taxpayers, Mr. Romney.? Furthermore, when nearly every state in the union is operating at a deficit, it creates a drain on the federal government. It?s in our national interest to stop this wasteful, irresponsible spending at the state level.

Before I cast my vote next month, I?d like to know where the candidates stand on this issue.? Currently, of course, all companion-animal laws are enacted at the state or local level.? There is nothing, however, that precludes our national politicians from having an opinion on states issues, and from putting forth ideas on how to solve them (and, if you need examples of that, see same-sex marriage, Roe v Wade, and other issues that are active at both a national and state level).? Both candidates own, or have owned, companion animals (I can hear all those Seamus-on-the-roof or Obama dog-eating comments now), and I assume they both love their dogs.? Disclosing their stances on the companion animal crisis will tell us a lot about these two men: their capacity for compassion, their problem-solving abilities, their willingness to acknowledge a problem that affects millions who don?t have a voice of their own, but are every bit as much a part of the American fabric as you or I.

On behalf of the millions of Americans who care about this issue, and on behalf of the millions of companion animals who will not survive their time in a shelter this year, I ask that this subject be broached at the next Presidential debate on Tuesday, October 16th.

Kaspersky Labs' namesake Eugene Kaspersky is worried that widely distributed and potentially state-sponsored malware like Flame and Stuxnet pose dire threats to often lightly protected infrastructure like communication and power plants -- whatever your nationality, it's clearly bad for the civilian population of a given country to suffer even collateral damage from cyberattacks. To minimize future chaos and literally keep the trains running, Kaspersky and his company are expanding their ambitions beyond mere antivirus software to build their own, extra-secure operating system just for large-scale industry. The platform depends on a custom, minimalist core that refuses to run any software that isn't baked in and has no code outside of its main purposes: there'll be no water supply shutdowns after the night watch plays Solitaire from an infected drive. Any information shared from one of these systems should be completely trustworthy, Kaspersky says. He doesn't have details as to when the OS will reach behind-the-scenes hardware, but he stresses that this is definitely not an open-source project: some parts of the OS will always remain confidential to keep ne'er-do-well terrorists (and governments) from undermining the technology we often take for granted.

Curiosity rover's second scoop discarded, third scoop of Martian soil commanded

ScienceDaily (Oct. 15, 2012) ? Commands will be sent to Curiosity today instructing the rover to collect a third scoop of soil from the "Rocknest" site of windblown Martian sand and dust. Pending evaluation of this Sol 69 (Oct. 15, 2012) scooping, a sample from the scoopful is planned as the first sample for delivery -- later this week -- to one of the rover's internal analytical instruments, the Chemistry and Mineralogy (CheMin) instrument.

A later scoopful will become the first solid sample for delivery to the rover's other internal analytical instrument, the Sample Analysis at Mars (SAM) instrument.

The rover's second scoopful, collected on Sol 66 (Oct. 12), was intentionally discarded on Sol 67 due to concern about particles of bright material seen in the hole dug by the scooping. Other small pieces of bright material in the Rocknest area have been assessed as debris from the spacecraft. The science team did not want to put spacecraft material into the rover's sample-processing mechanisms.

Confidence for going ahead with the third scooping was based on new assessment that other bright particles in the area are native Martian material. One factor in that consideration is seeing some bright particles embedded in clods of Martian soil. Further investigations of the bright particles are planned, including some imaging in the Sol 69 plan.

Sol 69, in Mars local mean solar time at Gale Crater, will end at 5:01 a.m. Oct. 16, PDT (8:01 a.m., EDT).

Reddit's Internet 2012 bus campaigns for Web freedom

Entering this enormous bus???draped like an American flag in red, white, and blue???is like going through rooms of a house. First you enter the cramped living room, then a small kitchen, with a sink and fridge on your right and a full bath on your left. The back dining room?s furnished with cushioned seats that wrap around a large, fold-up table.

Most importantly, there?s Wi-Fi and plenty of outlets, because people are using their laptops on that table. This isn?t an ordinary vehicle. It?s the Internet 2012 Bus, driving nearly 2,000 miles across America?s heartland during election season.

In 2008, the same vehicle was used by John McCain for his presidential run, dubbed the ?Straight Talk Express.? Now, it's been given a social media update, with crowdsourced support from the likes of Craigslist founder Craig Newmark, whose name, along with seven other prominent donors, is displayed on the side of the bus. And it?s being?escorted by a?Rally Fighter, a real-life Batmobile that holds the distinction of being the?first car with Creative Commons-licensed designs openly available on the Internet.

They?re coming, perhaps to your hometown, to ensure you realize that the Internet is a political issue worth fighting for.

Behind the wheel, at least symbolically, is Alexis Ohanian, the tall, gregarious, and bright-eyed cofounder of Reddit, along with general manager Erik Martin. Their tremendously popular social news site, which hit 3.4 billion pageviews in August, has become a leader and rallying force in the fight for Internet rights. ??

Back in January, when Congress considered the Stop Online Piracy Act (SOPA)???an anti-piracy bill that would allow sites to be censored if a visitor posted a link to illegal material???Ohanian personally warned members of Congress about the bill, proclaiming it would ?break the Internet.? And Reddit was the first major site to promise to go dark Jan. 19 for what would become a massive, successful ?strike? against SOPA, with thousands of sites following suit.

Noting the site?s reach and importance, President Obama even visited Reddit last month for its version of a digital town hall meeting, becoming the latest in a long line of politicians and celebrities to field questions and address concerns directly from users. With the Internet 2012 Bus, Ohanian and Martin are turning the tables, hitting the campaign trail in real life and bringing Reddit to your doorstep.

The spectre of SOPA looms large over the trip. The eight-day itinerary is packed with talks, panels, and tours of places with varied ties to the Internet and SOPA, which has become shorthand for any kind of bill that would censor or limit the Web.

?There are going to be more threats to the open Internet that are going to look far less obviously sinister than SOPA,? Ohanian told me as the bus geared up for its first stop???largely referring to lobbyists who represent companies that produce intellectual property, like the movie industry, who have influence in Washington and don?thave a greatrecord when it comes to making sure the Internet stays open and free.

?It?s going to be this sort of death by a thousand cuts.?

That, more or less, is the reason why Reddit has hit the road. Unlike the charge against SOPA???a grand stand that included blackouts of major websites and countless calls to representatives in Congress???this campaign aims to inform voters about what?s at stake before it?s too late, and to inspire them not just to fight against a looming threat, but to stand up for Internet rights routinely. ?

?It?s a lot easier to be against something than for something,? Ohanian explained, ?but that?s why we have to do this.??

Internet?rights ignored by Obama, Romney

Before the bus hit the road, TestPAC, a political action committee founded by redditors, tried to spark a movement to get Barack Obama and Mitt Romney to discuss Internet freedom at the first presidential debate at the University of Denver on Oct. 3. It didn?t work.

Small businesses, on the other hand, were mentioned 22 times between the two candidates. ?It?s small business that creates the jobs in America,? Romney said. Obama bragged that he ?lowered taxes for small businesses" 18 times.

That wasn?t lost on Ohanian and Martin, who, just six miles away, at a bar in downtown Denver called Katie Mullen?s, were hosting a debate-watching party for local redditors. The irony, of course, is that you can no longer separate small businesses and startups from the Internet or propose legislation for one without considering the other. That?s a fundamental issue that weighs heavily on the Internet 2012?s tour itinerary.

?Everywhere we?ll stop, we?ll get to have some cool conversations about the Internet, startups, and jobs,? Martin said the next morning, standing outside the bus before it first left Denver.

Indeed, the bus?s two dozen or so destinations are often small businesses, like Modular Robotics, a small factory that creates what?literally is the building blocks for simple robots. Likewise, Martin and Ohanian will pull over several times to host?panels on Internet startup companies and attend talks, most notably Iowa City?s Startup Weekend.

?For a lot of politicians, it?s really hard to grok that a company could start with one or two people, a little bit of money, like literally enough money to put a roof over their heads and food in their bellies, and within a few years could be valued at a billion dollars and be employing hundreds of people and changing the world,? said Ohanian, shown below speaking with activists, a few days later.

?That?s really hard to grok if you don?t understand the Internet startup economy.?If you had laws in place that are impediments to that, all of a sudden you?re stifling so much potential innovation.?

The?Internet and American values

Before going to the first of the trip?s panels, titled ?The Internet + Politics: Why You Should Give A S***,? the bus took a detour to the Foundry Group. A Boulder-based venture capital firm, Foundry invests early and often in the kinds of online startup companies Internet freedom is thought to promote. Ohanian and Martin wanted to meet with Ryan McIntyre, the company?s managing director.

After 11 folks from the bus piled into the Foundry Group?s sterile conference room, Martin asked McIntyre what the Internet had to do with American values.

?[The Web is] a fundamental mirror of core American traits,? he responded, his head covered with a mop of brown hair, giving him the look of an aging pop star.

?We?ve always had a frontier mentality, a pioneer mentality. Obviously we jealously guard our freedom of speech. You can?t argue against the Internet being a massive enabler of that.?

As he spoke, a documentary crew entered with quiet apologies, setting up across from McIntyre.

?See if you can get Erik, around the shoulder,? said one of the documentarians. Later, when McIntyre went long on an answer, that same documentarian interrupted him.

?Can you hold for one second while I switch batteries?? he asked. ?And can you restate that last part?? he grinned, then joked: ?I want this to be as produced as possible.?

McIntyre, though, was unfazed. Ohanian went on to ask about what the Founding Fathers would have thought about the Internet.

?Ben Franklin made one of his businesses as a newspaper,? McIntyre answered. ?He benefited from the printing press. You think of all the handbills passed around during the time of the American revolution; that was a?sneakernet version of the Internet back then. They recognized the power of disseminating information freely and efficiently?...?

?Pseudonymously,? Martin interjected.

?Pseudonymously. To cause a revolution.?

McIntyre paused, looking at the documentary crew before bringing his gaze back to Ohanian and Martin and finishing his point.

?You know, openness and individuality, and the anti-hierarchical aspect of the Internet, have a lot of parallels with what we believe our core cultural values are in America,? he said.

As McIntrye finished his last answer, Martin flashed him a smile and stood to say goodbye. ?We gotta run,? he said.

?Hopefully there?s something useable in that footage,? McIntyre said.

Reddit?co-founder: 'SOPA would have?crushed?startups'

On the bus ride back that night, Ohanian reminded me he?s a self-proclaimed ?startup guy.? He sold Reddit to Conde Nast in 2006 for somewhere?between $10 and $20 million and has since started several smaller Web-related companies. He?s an investor too, not just the founder of Reddit but someone who?s started and a number of other sites since then.

?I?ve got my entrepreneur hat; I?ve got my investor hat,? he said. ?But underneath them I?m just an American citizen,? he said, earnestly.

I mentioned how he often cited Reddit, the site that made him a millionaire, as a prime example of the kind of site that SOPA could have shuttered immediately.

?That was obviously an example that hit home with me,? Ohanian laughed, pausing momentarily and becoming a little more introspective.

?SOPA would have crushed startups,? he continued. ?They would have had to sign on all kinds of legal costs and had lawyers at the ready. More frightening is that so many bright people who would have started the next Facebook or the next Reddit wouldn?t. They?d say, ?Oh that?s not a business I want to get into. I don?t want to invest all that time and energy and hard work into being an entrepreneur. I?m just gonna get a job somewhere else, do some other thing.?

?And that?s the thing that really terrifies me. The things that couldn?t happen if the values of Internet freedom?weren?t nurtured. I just don?t want to see any of those get wasted.?

Enter the Lenovo Essential H520s ($449 direct), a desktop that can discreetly fit in some pretty tight workstations thanks to a compact profile that is, in Lenovo's estimation, roughly half the size of a traditional desktop. The H520s can be configured in several ways, and our review unit's configuration landed it under $500. It's a decent performer and most of its faults, like the absence of USB 3.0 connectivity and the inclusion of an older, second-generation "Sandy Bridge" processor, are forgivable when taking its price into consideration. That said, though, there are smaller and more forward-looking entry-level desktop PCs that are better choices for small businesses looking to save space and boost productivity.


Design and Features
The H520s is housed in a chassis that measures 12 by 4.1 by 14.2 inches (HWD). It's slightly taller and wider than the Acer Aspire AX1930-UR10P and significantly larger than the Lenovo ThinkCentre M92p Tiny, but slim and compact enough to discreetly fit in the even the most cramped desk spaces. The H520's black matte-finished chassis is fairly subdued, though it sports a handsome front panel that juxtaposes a brushed metallic finish with touches of glossy black plastic and thin, silvery strips. A vertical slot-loading DVD burner is built into the brushed aluminum portion, while the upper plastic section houses a media card reader, dual USB 2.0 ports, and audio-out and microphone-in jacks. The upper lip of this area is also where the power button is located. The rear of the H520s houses four USB 2.0 ports, VGA and HDMI outputs, an Ethernet port, and audio-out and microphone-in jacks. The H520's 1TB 7,200rpm hard drive mercifully comes with less preloaded software than one would expect in a sub-$500 system. With surprisingly few exceptions (namely a Google toolbar and Windows Live Essential), most of the preloaded software serves a useful purpose, like full versions of McAfee Antivirus Pro and the CyberLink Power2Go burning suite. There's also a Starter version of Office 2010?which only features Word and Excel, and with limited functionality.

Performance
Lenovo H520s Our review unit came equipped with a 3GHz Intel Core i5-2320 "Sandy Bridge" second-generation processor and an integrated Intel HD 2000 GPU, and was an overall decent performer. Intel HD Graphics 2000 isn't Direct X11 compatible, however, so the H520s couldn't run the Lost Planet 2 DX11 or 3DMark 11benchmark tests. This is fairly common among entry-level systems, like the Acer AX1930-UR10P and Lenovo Edge 71, so it's not terribly surprising. The H520s's PCMark7 score of 2,864 points trumped the rest of its class, edging past the Lenovo Edge 71 (2,826 points) by a whisker while outperforming both the Lenovo M92p Tiny (2,491 points) and Acer AX1930-UR10P (2,371 points) by a wider margin.

The H520s excelled in our multimedia tests. It completed our Handbrake video encoding test in a class-leading 1 minute 21 seconds, outpacing the Lenovo M92p Tiny (1:30) by a narrow margin and easily besting the Lenovo IdeaCentre Q180 (7:24). Likewise, its CineBench R11.5 score of 4.9 points breezed past the competition, including the Lenovo M92p Tiny (3.24) and Acer AX1930-UR10P (3.2). Our Photoshop CS5 test was the sole instance in the multimedia arena where the H520s didn't come out on top, as its time of 3 minutes 39 seconds fell behind the Lenovo M92p Tiny (3:21) and was two seconds short of the Acer AX1930-UR10P (3:37).

Like the rest of its class, the H520s no gaming rig, so it's no surprise that it scored 13 frames per second (fps) in medium-quality settings and 2fps in very high-quality settings. The Lenovo H520s combines decent performance and good value into a compact chassis. Still, it's not as forward looking or as compact as the current Editors' Choice for entry-level business desktop PCs, the Lenovo ThinkCentre M92p Tiny, and for that reason the latter remains the system to beat.

An Austrian daredevil plummeted into the record books today (Oct. 14), breaking the mark for highest-ever skydive after leaping from a balloon more than 24 miles above Earth's surface.

Felix Baumgartner stepped into the void nearly 128,000 feet (39,000 meters) above southeastern New Mexico Sunday at just after 12 p.m. MT (2 p.m. ET, 1800 ?GMT), then landed safely on the desert floor about 20 minutes later. His harrowing plunge shattered the skydiving altitude record, which had stood for more than 50 years, and it notched a few other firsts as well.

During his freefall, for example, Baumgartner was expected to be the first skydiver ever to break the sound barrier, which is about 690 mph (1,110 kph) at such lofty heights. And this happened on a special day ? today is the 65th anniversary of the first supersonic airplane flight, which was piloted by American Chuck Yeager in 1947 aboard the Bell X-1 rocket plane.

Unofficial results of the jump showed Baumgartner spent about 4 minutes and 22 seconds in freefall, a bit short of the longest freefall record, but that he had a speed of about 700 mph, which would clinch the supersonic milestone, Red Bull Stratos officials said.

About the only glitch during the jump was a problem with the faceplate heater in Baumgartner's helmet, which the skydiver and his Mission Control team worked on?during the hours-long ascent. They ultimately decided to proceed with the jump despite the heater glitch, and later Baumgartner reported the heater was working.

While in freefall, Baumgartner said his visor was fogging up during the dramatic descent.After minutes falling toward Earth, his parachute deployed as applause erupted from his Mission Control.

Project officials touted the skydive as a "space jump," calling it a "Mission to the Edge of Space."

The officially recognized space border is actually higher. Most experts generally regard space to begin at an altitude of 62 miles (100 kilometers), or about 327,000 feet.

The balloon was originally supposed to take off Monday (Oct. 8), but that launch, and another attempt Tuesday (Oct. 9), were called off because of gusting winds. Even moderate breezes can damage the enormous balloon, which is made of material 10 times thinner than a plastic sandwich bag, Red Bull Stratos officials have said.

Some of the daredevil's close friends and family ? including his parents, Felix and Eva ? made the trip from Austria to witness his record-breaking leap, mission officials said.

"I know he is perfectly prepared," Eva Baumgartner said in a statement before her son's jump, which he had spent five years readying for. "I am happy that he can do this; he worked hard for it. It is his childhood dream coming true."

Baumgartner worked up to today's leap in a stepwise fashion, jumping from 71,581 feet (21,818 m) this past March and then from 97,146 feet (29,610 m) on July 25.

East LA family, OLA fight foreclosure of home | l.a. activist

At the request of a homeowner under foreclosure, occupiers have barricaded themselves inside another home. They hope to stave off eviction and force an amicable arrangement with the mortgage lender.

According to the homeowners, Margarita Lucero and her brother Benito, and occupiers, Deutsche Bank is fraudulently foreclosing on the Lucero home.

On the day the Luceros signed the paperwork for a loan modification, their first payment was already due ? the day before. After making six payments on their loan modification, Deutsche Bank began refusing their payments ? unbeknownst to the Luceros the modification was only temporary.

The bank then put the home into foreclosure.

?From the very beginning of the loan modification process, it was set up to fail,? said Carlos Marroquin of Occupy Fights Foreclosures, a affinity group of Occupy Los Angeles who has been working with the Lucero family.

?They just started rejecting the payments,? he said. ?It was a way of saying, ?We are not going to modify you and we are going to take your house.??

Once the foreclosure process was underway, the Lucero family, who had owned their home for 15 years, filed for bankruptcy to put off their impending eviction, which the courts granted them until Oct. 26. However, a month before, on Sept. 27, acting on Deutsche Bank?s instructions, Atlantic and Pacific Real Estate and sheriffs evicted the family despite the court order.

Forced to live in their car, the family reached out to Occupy LA for assistance.

?Their was a clear violation of federal law; that is a major part of the fraud,? said Marroquin. ?Most of the people, once they are evicted, it is very hard to get anybody back into their home. Fortunately, the family came to Occupy LA, and we understand what it takes to fight this.?

Given the evidence, Marroquin is hopeful the Luceros will be able to keep their home. That, however, does not mean the Luceros and occupiers are not preparing for a fight.

They have been building a barricade in front the residence using discarded plywood, shipping pallets and whatever else they can find laying about. They are readying themselves for the sheriffs.

Activists are ready to take Deutsche Bank and given that they violated a court order, said Marroquin, it would be in their best interest to settle this as quickly as possible.

?They ignore the laws of the land and they go after the homeowner regardless if there are judgments or not,? he said. ?That is very serious.?

Wounded survivor testifies as Ohio Craigslist murder trial opens

AKRON, Ohio (Reuters) - A man lured to Ohio by a phony Craigslist job ad testified on Friday that a teenager charged with trying to kill him waited in a car while an accomplice walked into a heavily wooded area with the victim and shot him last November.

"I heard a curse word. I heard a gun cock. I knew I was in trouble," Scott Davis, 49, testified as the first witness called by prosecutors in the trial of Brogan Rafferty.

Rafferty, 17, and Richard Beasley, 53, are charged with the aggravated murders of three men found buried in shallow graves around Ohio last year. Beasley faces the death penalty in a separate trial expected to begin in January.

The teenager, who was 16 when he was arrested and is being tried as an adult, faces up to life in prison if convicted of killing David Pauley, 51, of Norfolk, Virginia; Ralph Geiger, 56, of Akron, Ohio; and Timothy Kern, 47, of Massillon, Ohio.

Davis told jurors he sold a landscaping business in South Carolina to move closer to his parents in Ohio and met Rafferty and Beasley when he responded to an ad for a farm hand.

He spun around when he heard the cocking sound, saw a gun pointed at his face and was shot in the right elbow as he tried to push the gun away, Davis said.

"I ran as fast as I could but I kept falling down," Davis said. "He continued to fire at me as I ran out of the woods and out into the road."

Davis said he hid in a partially dried up creek bed listening for Rafferty's car and walked for help hours later, still badly bleeding, as it got dark. The bullet was surgically removed and he spent five days in the hospital.

When asked if Rafferty seemed to be under duress when he met him, Davis said: "He didn't look nervous or scared."

In opening statements on Friday, prosecutors described Rafferty as an "apt pupil" who chose to help Beasley kill and bury the men, while defense attorneys said he was the victim of a broken home and abusive father/son relationship with Beasley.

"You will hear a lot of things but what you will not hear from him is remorse," Special Summit County Assistant Prosecutor Emily Pelphrey told jurors.

Prosecutors displayed pictures of the three men killed and a timeline of when they answered the ad, were killed and when their bodies were recovered.

"All of these men were looking for a new shot, a fresh start and they thought that their luck was about to change," she said.

Rafferty's attorney, John Alexander, told jurors the teen, who wore a green golf shirt and khakis, did not know how to get out of the relationship with Beasley and was shattered when he saw Beasley shoot Geiger in the back of the head in August 2011.

"There is a monster in this case and that monster is not Brogan Rafferty," Alexander said. "The monster in this case is Richard Beasley."

The Ohio case is one of a series across the nation involving perpetrators who either found victims through the Craigslist website or other social media sites, or used the Internet for criminal purposes.

A man was arrested in Texas in March and charged with people-smuggling for allegedly using Craigslist to recruit drivers for a scheme to transport illegal immigrants.

In 2009, a former medical student was accused of killing a masseuse he met through Craigslist and police believe a serial killer, or killers, in the New York area may be preying on prostitutes who advertised on the site.

In other incidents, victims advertising goods for sale have been attacked and killed as have those responding to ads. Two men in Tennessee were accused last month of killing a man and a woman for "defriending" the daughter of one of the suspects on Facebook.

The Ohio trial before Judge Lynne Callahan is set to resume on Monday and could last six weeks.

Thomas Werner, assistant professor of biological sciences at Michigan Technological University, and his PhD student, Komal Kumar Bollepogu Raja, have discovered that three genes that cause cancer and disease in humans also "paint" the spots on the fly's body. This discovery could enable researchers to study how those genes work in fruit flies and apply that knowledge to treating cancer in people.

"The last common ancestor of man and fruit flies lived about 600 million years ago," says Werner. "All the genes needed to build a body were already present in that ancestor, and today we still share virtually all of our body-building genes with fruit flies. This is why we are able to study human diseases like cancer in fruit flies."

Werner and Raja are interested in how DNA encodes body forms and patterns in animals. They use color patterns as a model.

They've made strong connections between developed spots and three genes, all of which have cancer- and disease-causing counterparts in humans. Thus, the abdominal spots of this tiny fruit fly could be a great model for understanding genetic pathways that cause cancer.

"We are looking here at proto-oncogenes, which are cancer genes that cause disease when they are active in an uncontrolled manner," Werner explains. "Both humans and flies have them, and in flies they learned to paint black spots on the abdomen."

This reveals that old genes can learn new tricks; they just need to become part of a new genetic pathway, like, in this case, adding designer patterns to a boring garment. "And you get your evolutionary novelty without having to invent new genes," Werner says.

Werner's been down this research road before. He introduced stripes onto the spotted wings of fruit flies ("from a leopard to a zebra"), showing that a certain cancer gene is sufficient to induce pigment patterns on Drosophila wings, and landed on the cover of Nature, one of the leading scientific journals in the world. The magazine's cover hangs in his office.

"Now we want to use our new methods to find out how the abdominal pigment pattern is generated, and how it is encoded in DNA," says Raja."

The genes that seem to paint the pigment spots on the abdomen are important for other reasons, Werner says. Some of them have additional roles in defining the head-to-tail axis in animals and are crucial for the proper development of the vertebrae in humans. If these genes misbehave during the development of the human embryo, gross disabilities or embryonic death will occur.

"Many diseases like cancer and vertebra-related disabilities are caused by the 'misbehavior' of genes, when they are expressed at times and places or in amounts they are not supposed to be," Werner says. "Our work focuses on understanding how the cancer- and disease-causing genes in the fruit fly are regulated, and how they regulate their downstream target genes."

The biggest promise for the future, however, involves those three "bad" genes. By studying them, Werner and Raja believe they can identify targets for gene therapies against cancer and genetically inherited developmental defects.

Targeting these genes when they start misbehaving could lead to happier and healthier tomorrows for many people: a grand result from research on miniscule flies.

Microsoft: Windows XP has the highest infection rate

Microsoft has released its latest bi-annually Security Intelligence Report covering the first half of 2012 which offering a worldwide threat assessment for that period. One of the highlights of the report is the average infection rate of popular Microsoft client and server operating systems.? According to the report, Windows XP SP3 systems are on average twice as likely to get infected as Windows Vista or Windows 7 systems. The system with the lowest number of average infections is the 64-bit version of Windows 7 SP1, with 3.1 infections per 1000 computers compared to XP?s 9.5 infections per 1000 computer systems.

It is interesting to note that infection rates for 64-bit versions of Windows Vista or Windows 7 are lower than infection rates for 32-bit versions of the operating system.

When you look at the trend chart, you will notice that the average infection rate of Windows XP and Windows 7 systems is on the rise, while that of Windows Vista has dropped significantly in the first half of 2012. Windows 7 infection rates only increased slightly in the first half though, while Windows XP infection rates made a huge jump to over 10.0 in the second quarter of 2012. This jump is attributed to the worm family Win32/Dorkbot and the trojan downloader Win32/Pluzoks by Microsoft.

Miscellaneous trojans lead the thread category listing, followed by the potentially unwanted software, worms, adware, trojan downloaders and droppers and exploits.

  • The increase in Miscellaneous Trojans, the most commonly detected category during both quarters, was driven by an increase in the generic exploit family JS/IframeRef and the rogue security software family Win32/FakePAV.
  • Miscellaneous Potentially Unwanted Software detections remained consistent through both quarters. Win32/Keygen, a generic detection for tools that generate keys for various software products, was the most commonly detected family in this category.
  • The Adware category has declined significantly over the past several quarters, from 1st as recently as 3Q11 to 4th in 2Q12. Significantly reduced detections of JS/Pornpop, Win32/Hotbar, and Win32/OpenCandy have been the biggest contributors to the decline.
  • The Exploit category, which had been increasing gradually for several quarters, fell slightly in 2Q12. This trend corresponds to the increase and apparent peaking of the Blacole exploit kit.

  • The United States and the United Kingdom, two predominantly English speaking locations that also share a number of other cultural similarities, have similar threat mixes in most categories. The Miscellaneous Trojans category is more prevalent in both places than in others primarily because of detections of the English-language rogue security software family Win32/FakePAV, 72.7 percent of which involved computers in the US? and UK.? Exploits are somewhat more prevalent in the UK than in the US because of the Blacole exploit family, which was detected on proportionally more computers in the UK.
  • In Russia, the Miscellaneous Potentially Unwanted Software category is especially prevalent, led by Win32/Pameseg and Win32/Keygen. Pameseg is a family of installers that require the user to send a text message to a premium number to successfully install certain programs, some of which are otherwise available for free. Currently, most variants target Russian speakers.
  • Brazil has long had higher-than-average detections of Password Stealers & Monitoring Tools because of the prevalence of malware that targets customers of Brazilian banks, especially Win32/Bancos and Win32/Banker. In 2Q12, Brazil accounted for 69.9 percent of computer reporting Bancos detections worldwide, and 42.4 percent of computers reporting Banker detections.
  • Korea had significantly higher-than-average detections of the Trojan Downloaders & Droppers and Adware categories, and significantly lower than-average detections of all other categories. The high level of Trojan Downloaders & Droppers detection was driven by large numbers of computers infected withWin32/Pluzoks. The high level of Adware detections was driven by Win32/Wizpop, which monitors users? Web browsers and diverts requests for certain URLs to a Korean-language site. In 2Q12, 90.4 percent of computers reporting detections of Wizpop were located in Korea.
  • Worms were especially prevalent in Turkey in 4Q11 because of Win32/Helompy, a worm that spreads via removable drives and attempts to capture and steal authentication details for a number of different websites or
    services. The worm contacts a remote host to download arbitrary files and to upload stolen details. In 2Q12, 63.2 percent of computers reporting detections of Helompy were located in Turkey. For more information about Helompy and Turkey.
  • Worms and viruses were particularly prevalent in India, driven by detections of the generic worm family Win32/Autorun and the virus families Win32/Sality and Win32/Ramnit.

It needs to be noted that the report is looking at the big picture, and while that means that Windows XP SP3 systems have a higher average infection rate than Windows 7 systems, it does not mean that individual XP systems are more likely to get infected than Windows 7 systems. In the end, it comes down to updates, the software that is installed on the system, the security of the system, the user?s activities and other factors.
